These Terms of Service (“Terms”) govern your access to and use of the OnlyFund website and services (“OnlyFund,” “we,” “us,” or “our”). By accessing or using our services, you agree to these Terms. If you do not agree, do not use the services.
Eligibility
Our services are intended for adults (18+) and, where applicable, for accredited investors as defined under applicable securities laws. You are responsible for ensuring your use complies with the laws that apply to you.
Nature of the platform — no offer or advice
OnlyFund provides information and tools that connect accredited investors with real estate development opportunities. Nothing on the platform constitutes investment, legal, tax, or financial advice, an offer or solicitation to buy or sell any security, or a recommendation. Any securities offering is made solely through official offering documents provided by the applicable issuer. Investing involves risk, including loss of capital.
Use of the services
You agree to provide accurate information, keep your credentials secure, and use the services only for lawful purposes. You may not misuse the services, attempt to gain unauthorized access, or interfere with their operation.
SMS / text messaging terms
By providing your mobile number and opting in (for example, by submitting a contact request and selecting a text preference), you agree to receive SMS text messages from OnlyFund related to your inquiry, including follow-ups to schedule a call, confirmations, and customer-care replies. These messages are transactional and conversational in nature.
Message frequency varies. Message and data rates may apply. You can cancel at any time by replying STOP, after which we will send one confirmation and stop messaging you. Reply HELP for help. Carriers are not liable for delayed or undelivered messages. Your consent to receive messages is not a condition of any purchase. See our Privacy Policy for how we handle your information; we do not share mobile opt-in data with third parties for marketing.
Intellectual property
The services, including content, trademarks, and software, are owned by OnlyFund or its licensors and are protected by law. You may not copy, modify, or distribute them without permission.
Disclaimers
The services are provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, OnlyFund will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the services.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles.
Changes to these Terms
We may update these Terms from time to time. Continued use of the services after changes take effect constitutes acceptance of the revised Terms.
